New York Cannabis and Vape Guide

Adult-use cannabis in New York
New York permits adults aged 21 and older to possess up to 3 ounces of cannabis and up to 24 grams of cannabis concentrate, including cannabis oil and edible products. Adults may store up to 5 pounds of cannabis at home. Cannabis sales are lawful only through businesses licensed by New York’s Office of Cannabis Management.
Licensed cannabis delivery exists in New York. Delivery must be handled through the state’s licensed cannabis system, and availability depends on the destination and applicable rules. Products cannot cross state lines. Taking cannabis from New York into another state, or bringing it into New York from elsewhere, remains illegal, including medical cannabis.
Do not treat online availability as permission to ship cannabis to every address. Orders must be limited to lawful destinations and may require age and delivery verification. Cannabis cannot be sold or transferred without the required license, and so-called gifting arrangements connected to a paid service or commodity are prohibited.
Nicotine vapes in New York
New York prohibits the sale of flavored vapor products, including menthol, unless a product has the required FDA marketing order. In practice, New York’s statewide rule allows only tobacco-flavored or unflavored vaping products for sale. The restriction covers nicotine-containing vapor products and related vape formats.
New York also taxes vapor products at 20% of retail price. Beginning September 1, 2026, the state’s tobacco-products tax extends to alternative nicotine products at 75% of wholesale price, with licensing and registration requirements for covered businesses.
For ordering vape kits, pods and e-liquids, this means product format does not override New York law. A kit, cartridge, refillable device, disposable or liquid must meet applicable flavor, tax, licensing and destination requirements. New York City has additional rules: e-cigarette retailers need a city license, and delivery of tobacco or electronic-cigarette products to consumers in NYC is prohibited.
