Massachusetts Cannabis and Vape Guide

Massachusetts adults can access regulated adult-use cannabis and nicotine vaping products, but the rules differ. Products ship only where legal, and cannabis orders must remain within Massachusetts. Adults must be 21 or older to purchase or receive either product category.

Adult-use cannabis in Massachusetts

Adults 21 and older may purchase cannabis from Massachusetts-licensed retailers and possess up to 1 ounce of cannabis in public. At home, the personal possession limit is up to 10 ounces, subject to Massachusetts rules regarding legally cultivated home cannabis. Retail purchases are also subject to the state’s daily purchase limits and product-equivalency rules, so the amount allowed depends on the product type.

Licensed adult-use delivery exists in Massachusetts. Massachusetts has extended the delivery-license exclusivity period through April 1, 2029, with these delivery models reserved for qualifying Social Equity Program Participants and Certified Economic Empowerment Priority Applicants. Local delivery availability and community rules can still apply.

Cannabis cannot cross state lines. Do not carry Massachusetts cannabis to another state, even when the destination also permits cannabis, and do not order cannabis for shipment across state borders. Cannabis products are available only where the transaction and delivery comply with Massachusetts law.

Nicotine vapes in Massachusetts

Massachusetts prohibits the retail and online sale of flavored tobacco and flavored vaping products to consumers, except for limited on-site consumption at licensed smoking bars. This restriction affects flavored vape kits, pods, disposable devices and flavored e-liquids. A product described as flavored may not be lawful for ordinary retail delivery to a Massachusetts consumer.

Massachusetts also applies a 75% excise tax to the wholesale price of electronic nicotine delivery systems, including vaping liquid or gel and device accessories such as batteries, in addition to the state’s 6.25% sales tax. Retail stores may sell non-flavored nicotine vaping products only within the applicable nicotine-content and licensing limits. Non-flavored products above 35 mg/ml are restricted to licensed retail tobacco stores or smoking bars.

For ordering, that means eligible adults should select only products that comply with Massachusetts flavor, nicotine-content, licensing and tax rules. Availability of a kit, pod or e-liquid in a catalogue does not override state law. Orders are age-restricted, subject to address and product checks, and ship only where legal.
